Description
The Employment Counsel contributes to TSI’s success by managing a diverse and challenging array of labor and employment matters in support of the company’s 8,000+ team members. The Employment Counsel will leverage their prior law firm and in-house experience to effectively partner with Human Resources to create internal best practices on managing employee relations matters, oversee the work of outside counsel on employee relations cases, and advise on external agency cases as well as internal employee relations investigations.
Responsibilities and essential job functions include but are not limited to the following:
Serve as key legal advisor on all major employee relations matters.
Assist the Human Resources Department with investigations on labor law and employee relations concerns.
Proactive review of employee relations handling to assist in legal/compliance matters.
Provide advice regarding potential employee disciplinary action
Represent the company before Federal and state agencies (i.e., EEOC, DOL, OHSA, etc…), including preparing position statements on employee relations inquiries and appearing at hearings on behalf of the company
Manage federal and state litigation, administrative proceedings and arbitrations involving employment law matters, including management of outside counsel, risk assessment, oversight of case discovery and case resolution
Conduct ongoing training of management on employee relations best practices and investigation techniques and compliancein partnership with the human resources department.
Minimize legal exposure through proactive review of existing routines and recommendation of new or revised ones.
Participate in the definition and development of employee relations policies, procedures and programs and provide continuing counsel and guidance on legal matters and on legal implications on employee relations matters.
Management of outside counsel.
Requirements
Summary of Required Skills and Experience:
BS and JD with admittance to the NYS Bar.
7+ years of related law firm and in-house legal experience.
Recent and substantial hands-on experience managing matters in employment litigation, and Federal and state administrative agency proceedings (e.g. EEOC, DOL, etc.) and arbitrations
Proven ability to manage outside counsel on complex matters
A practical, business-based approach to problem solving.
Excellent interpersonal skills that facilitate prompt and constructive solutions
Flexibility to travel
Must be flexible and able to handle logistics with respect to how cases are handled
