Disability claims are continuing to soar in a legal landscape that is increasingly volatile. Psychiatric or behavioral health claims are rising at such rapid rates that it is estimated that they will make up over 60% of the total number of disability claims in the next 3-5 years.

In addition to the growing number of psych claims, the recent landmark United States Supreme Court decision in State Farm v. Campbell will have a profound impact on the way the issue of bad faith within the context of disability claims is handled going forward.

In order to successfully evaluate and litigate individual and ERISA disability cases, insurance industry executives, claims counsel, and outside attorneys for both plaintiff and defense must have a complete and up-to-date understanding of the legal and medical issues in this complex and highly charged area of the law.
