Biography
Mr. Kennedy focuses his practice on employment related matters, employee benefits, regulatory compliance, discrimination and negligence issues. His clients include a broad spectrum of employers ranging from closely held corporations to Fortune 500 companies, all of which face daily issues involving employees and hiring and firing, discipline, workers’ compensation, and potential litigation before courts and/or state and federal agencies. He is also a member of the firm’s Health Care Reform Team, which advises employers on compliance with the new federal health care legislation.
Representative Matters
- Represents management in all areas of labor and employment law including litigation
- Deals with issues such as wrongful discharge, intentional torts, sexual, racial and disability based discrimination and harassment, severance, employment and non-compete agreements, workers’ compensation claims and Violation of Specific Safety Requirement (VSSR) investigations, and claims involving the Americans with Disabilities Act (ADA), Family and Medical Leave Act (FMLA), Occupational Safety and Health Administration (OSHA), Fair Labor Standards Act (FLSA), Equal Employment Opportunity Commission (EEOC) and the Ohio Civil Rights Commission
- Managed litigation involving defense of hospitals, physicians and nursing homes in negligence cases, as well as pharmacists and pharmacies in misfilled prescription matters
- Represents manufacturers and companies in asbestos claims and other product liability litigation
- Litigated cases in over 50 of Ohio’s 88 counties as well as in federal courts throughout Ohio
