R. JOSEPH BARTON is a Partner at Cohen Milstein Sellers & Toll, PLLC and a member of the firm’s Employee Benefits practice group. Mr. Barton graduated Order of the Coif from William & Mary Law School in 2000. Following law school, Mr. Barton clerked for Judge Nesbitt of the United States District Court of the Southern District of Florida. Mr. Barton is admitted to the Bars of the State of California and the District of Columbia. Mr. Barton generally represents employees in a variety of ERISA employee benefit disputes, including benefit disputes, fiduciary breaches or other ERISA or USERRA violations and also represents fiduciaries of plans with claims against other fiduciaries. He has been lead trial counsel for plaintiffs in several ERISA trials, including most recently, obtaining a judgment of $15 million in representing the fiduciaries of two plans suing their former investment manager for breaches of fiduciary duties. Mr. Barton has written and spoken on a variety of ERISA issues, including the issue of the ability of ERISA Plans and their fiduciaries to collect alleged overpayments from plan participants.
