Masterclass Curriculum

Module 1. Regulatory Framework & Jurisdiction: Identify what needs to be analyzed. Understand where encryption controls fit within the EAR and distinguish the hardware, software, source code and technology involved in a product or service. Learn to separate controls on encryption functionality from rules governing encrypted information—and assess potential exports through downloads, repositories, hosted environments and technical disclosures.

Module 2. Category 5 Part 2 Classification: Support the determination, not just the ECCN. Work through mass-market eligibility, authentication, ancillary cryptography and open-source components. Learn which technical questions to ask Engineering, when self-classification or BIS review is appropriate, what a CCATS establishes, and which product changes should prompt reassessment.

Module 3. EAR & ITAR Jurisdiction & Technology Access: Evaluate the product and the information separately. Examine commercial products and defense-specific variants, foreign-person access to development environments, and disclosures to employees, contractors and overseas teams. Work through EAR §734.18 and relevant ITAR requirements to assess encrypted storage, transmission and administrator access, including who can obtain controlled information.

Module 4. License Exception ENC & Continuing Compliance: Determine the authorization and what follows. Compare the principal §740.17 pathways against product functionality, recipients, destinations and activities. Understand classification-review requirements, waiting periods and licensing alternatives; distinguish annual self-classification reporting from semiannual transaction reporting; and identify the additional restrictions that must remain part of the transaction review.

The Masterclass Series also prepares attendees to get more value from the in-person Forum by establishing a common baseline for the deeper, operator-focused discussions that follow.
