On January 17, 2013, HHS's Office of Civil Rights (OCR) released the long- awaited Final Omnibus HIPAA Privacy Rule (the Final Rule) pursuant to the HITECH Act and answered many long pondered questions for HIPAA covered-entities and a now expanded-circle of business associates concerning privacy and security of protected health care information; breach notification; and enforcement. As HHS Secretary Kathleen Sebelius stated, “the new rule will help protect patient privacy and safeguard patients’ health information in an ever expanding digital age.”
